Philip Rivera has stated in the QTH feedback forum that he "sent me photo's of the radio prior to the sale". Here is the complete email thread between him and I which proves that statement is simply not true.
You do what you have to do, but if you keep the radio for an extended period of time, then it is a done deal.

Philip I am absolutely at loss for words. I am going to remove all the emotion out of this reply and just state what I feel is the bottom line. Please send me the exact amount that I sent you for the radio. I will send the radio back via UPS insured int he same box using the same packing material you sent it in. I will agree to pay all cost associated with shipping the radio back.
I have taken over 60 pictures and sent them to 8 people who are instrumental in running QTH. I have been phoned by 3 and have received email from the other 5. I included your original add in my emails with the pictures and ALL agree that this radio is less than a 6 out of 10 and was Grossly mis-represented in your qth add.
Under no circumstances will I send the radio back and Hope I receive a refund at some later date.
I await your reply prior to taking further action.

Phil, I just opened the radio. It made the trip fine, good packing. However it is not remotely as described in your add. Your add clearly stated "near mint" and "never been mobile". Attached is a picture of one side of the radio. This radio does not meet a standard rating guide utilized in the QTH forums of a 7 out of 10 much less "near mint".I would like to return it exactly as it was shipped only I will send it via UPS insured. I would like a full refund of the original purchase price.

I just came out of the Post Office where I shipped your radio from. They did a trace, and told me your Postal folks there left a notice on 11/20/2009 that was two days after I shipped it.

Another day with no radio. I am becoming concerned and stopped by the local post office who told me that normal priority would have delivered last friday from most zips in florida, and all zips in florida by Sat. They told me that you should have a priority receipt that your post office could use to locate the package.

one more thing, the rig was always used QRP (low power) about 10watts. when you get it set-up you need to go in the menu and put it on high if you want 100watts, that was on HF.
